Terms and Conditions

1. A minimum booking of 3 nights per stay is normally required but it may be possible to offer 1 or 2 night bookings at short notice, depending on availability. Reduced rates for bookings of 5 or more continuous nights apply.

2. The apartment is designed, furnished and equipped for a maximum of 6 guests per night. The proprietor or his agents reserve the right to terminate the booking if there are an excessive number of guests staying without prior permission or to charge an extra RM50 per night per each guest exceeding the total of number allowed.

3. Pool and sea views are offered from the apartment at present. However, all Marina Court sea views are affected by a waterfront development being built over the water in front of Marina Court. Eventually the majority of Marina Court apartments will lose their sea view. (Check my website www.marinacourt-sabah.com for up to date info). In any event, this apartment will always enjoy an attractive pool view.

4. The Booking Form and Deposit (20% of the total booking price) is required to confirm booking. A receipt for Deposit payment and a Booking Confirmation will then be emailed to you. (Please note that your booking is not fully confirmed until the deposit payment is received, although your requested dates may be held for 3 days from receipt of the completed Booking Form to give you time to pay the Deposit). In the event of cancellation, the Deposit is non-refundable (although we may offer a refund if and when we are able to fill the cancelled dates). Where a refund is eligible any Paypal charges and/or foreign exchange costs will be deducted if appropriate. Cancellation within 3 days of your stay will result in full payment being charged.

5. The balance of the full payment can be paid in cash on check-in or 14 days prior to arrival (see Clause 7 for payment methods). If paying in advance, a receipt for Full Payment and a Confirmation of Booking will then be emailed to you.

6. Electricity, gas and water used is included in the price unless otherwise stated.

7. Payment can be paid direct (by personal/internet/telephone banking) to the Proprietor's bank account either in Malaysia (in Ringgit) or UK (in GB Pounds). For most countries it may be possible to pay by credit/Debit card via Paypals secure website (for which a 2% surcharge will be added). Please email info@marinacourt-sabah.com to check if Paypal operates in your country or check direct with www.paypal.com

8. A refundable Breakages Deposit of RM600 (or equivalent amount in your own currency) must be paid in cash to the Proprietor's local agent on receipt of keys (or by card/bank payment 7 days before check-in). You will be issued with a receipt for the Breakages Deposit. On check-out the deposit will be returned to you in full providing there is no loss or damage to the apartments contents, fabric or structure for which a fair and appropriate deduction may be made. Please note that in particular if keys, remote control devices, art décor are lost or not left in the apartment when you depart, you will be charged to cover full replacement costs). In addition, there is a charge of RM50 to open the door if keys are locked inside the apartment and you may be charged the cost of replacing locks if keys have been lost. Any cost incurred to remove tobacco odours and damage may be deducted from your Damages Deposit (may include cost of cleaning carpets and curtains etc). Smoking is only allowed on the 2 balconies of the apartment.

9. Check-in time is after 3pm. Check-out time is before 12 noon on day of departure. Other times may be available by prior arrangement.

10. Housekeeping is not included (there is a washing machine within the apartment for guestsuse). Bed sheets and towels are provided. For longer bookings a change of bedding/towels may be provided on request for an extra charge.

11. Internet can be provided via a broadband USB dongle which can be rented on a daily rate. Alternatively, nearby cafes and restaurants provide free wifi Internet access to their patrons. An intercom in the apartment provides communication to the Security Guards.

12. As this is a privately owned apartment, it is asked that you respect this as a Non Smoking apartment but you are welcome to smoke on the balconies.

13. It is regretted that family pets and animals are not permitted.

14. It is recommended that you arrange your own travel insurance prior to your stay, as the apartment's insurance does not cover guests' personal belongings.

15. The Proprietor or his agents accepts no responsibility for any loss/damage or injury to any guests or their property.

16. The proprietor and his agents will endeavour to maintain all facilities and appliances in full working order and in the event of any malfunction, will strive to rectify the problem as soon as possible. Should events arise beyond the control of the proprietor and his agent, regarding the availability of this property, then the booking may be cancelled by the proprietor, in which event, all moneys paid as deposit or booking charges shall be refunded in full and the lesses shall have no further claims against the proprietor or his agents.
